Welcome to Explora. These Terms of Service ("Terms") govern your use of the Explora mobile application ("App") operated by Explora ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Explora, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

Explora is a location-based audio content application that delivers AI-generated stories about places you visit while driving. The App uses your device's GPS to determine your location and provide relevant content.

3. Eligibility

You must be at least 13 years old to use Explora. By using the App, you represent that you meet this age requirement. If you are under 18, you must have permission from a parent or guardian.

4. Account Registration

You may use Explora as a guest or create an account using Sign in with Apple. If you create an account:

• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information
• You must notify us immediately of any unauthorized use

5. Subscriptions and Payments

5.1 Free Tier

Explora offers a free tier with limited features, including 10 stories per month.

5.2 Paid Subscriptions

Paid subscriptions provide access to additional stories and features. Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

5.3 Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes in advance, and changes will take effect at the start of your next subscription period.

5.4 Refunds

All subscription purchases are processed through the Apple App Store. Refund requests must be directed to Apple in accordance with their refund policies.

6. User Conduct

You agree not to:

• Use the App while actively driving in a manner that distracts you from safe operation of your vehicle
• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App or servers
• Collect user information without consent
• Use automated means to access the App
• Share your account credentials with others

7. Safety Warning

IMPORTANT: Explora is designed to be used as a passenger-safe, hands-free audio experience. However:

• Always prioritize safe driving over app interaction
• Set up the App before you begin driving
• Do not interact with your phone while driving
• Obey all local traffic laws regarding mobile device use
• We are not responsible for any accidents or incidents that occur while using the App

8. Content and Intellectual Property

8.1 Our Content

All content in Explora, including but not limited to text, audio, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

8.2 AI-Generated Content

Stories in Explora are generated using artificial intelligence. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• Content is for entertainment and general information purposes only
• Content should not be relied upon for navigation, safety, or critical decisions
• We do not guarantee the accuracy, completeness, or reliability of any content

8.3 License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Location Services

Explora requires access to your device's location services to function. By using the App:

• You consent to the collection and use of your location data as described in our Privacy Policy
• You understand that location accuracy depends on your device and environmental factors
• You acknowledge that we are not responsible for any inaccuracies in location data

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages arising from unauthorized access to your data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Explora and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the App terminates immediately
• You must cease all use of the App
• We may delete your account and data

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last updated" date
• Sending notification through the App

Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Explora regarding your use of the App.

19. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (ACL) or any other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.
